TERMS AND CONDITIONS OF SALE:

Purchase Price: $500. $50 deposit due at time of signing. $450 due at time of pick up

Possession Date Window: July 29th-Aug 12th, 2023. All horned kids will be disbudded and all kids will be tattooed, microchipped; wethers will be banded before leaving SIZE MATTERS MICRORANCH unless sold as bottle babies.

1. SELLER requires a $50 deposit per animal to reserve animals for future pick up. Deposits on reserved animals are non-refundable except as otherwise provided herein.

2. If a reserved kid/goat is not picked up by the end of the Possession Date Window, BUYER will be charged $2/day board, or at SELLER’s option, BUYER’S reservation will be forfeited, and the Sale Animal will be re-listed for sale.

3. Upon payment of the Purchase Price in full, SELLER shall provide all papers necessary for BUYER to register the Sale Animal and/or transfer registered ownership of the Sale Animal to BUYER. BUYER will need to pay fees for the registration application or transfer. Some goats are double registered (MDGA and TMGR), and for these goats,

different fees will apply. Goats that are already registered cannot have their registered names changed.

4. In the event of the loss of the Sale Animal prior to being picked up by BUYER, SELLER shall return to BUYER any deposit paid.

5. Should the Sale Animal be described and sold as a pet/unregistered, no registration papers will be given to BUYER at the time of sale or in the future. BUYER agrees to abide by any breeding restriction set forth herein.

6. Any kids that are the result of a doe purchased bred will carry the SIZE MATTERS MICRORANCH herd name and BUYER’s tattoo numbers.

7. Any doe sold bred is guaranteed bred only if a positive blood test OR positive ultrasound result has been received by SELLER, however SELLER offers no guarantees or has any control over abortion, miscarriage, absorption or other loss of fetus, before or after delivery due to stress, management, natural causes, etc.

8. The Sale Animal will not leave SIZE MATTERS MICRORANCH and BUYER will not be issued registration papers or applications until SELLER has received payment in full of the Purchase Price.

9. BUYER is responsible for arranging any necessary transportation of the Sale Animal by a third party transporter and any tests and papers needed to allow the Sale Animal to cross state lines. BUYER agrees to provide the name(s) of any third party transporter, who will act as BUYER’s representative. Transfer of the Sale Animal to BUYER’s representative shall have the same effect under this Agreement as if the Sale Animal were picked up directly by BUYER. SELLER is not responsible for the health or welfare of the Sale Animal after transfer to BUYER’s representative.

10. BUYER represents that BUYER has had the option to review the condition and health of the Sale Animal, including the opportunity to arrange for a veterinary examination, at BUYER’s expense. If requested by BUYER, SELLER will arrange for an examination and/or tests by SELLER’s veterinarian at BUYER’s expense. If SELLER or a veterinarian deems the Sale Animal unhealthy prior to pick up of the Sale Animal by BUYER, SELLER will issue a refund of any deposit or offer a replacement animal to BUYER.

11. SELLER warrants delivery of clear title to the Sale Animal, and represents that, to SELLER’s knowledge, and except as described herein, the Sale Animal is healthy and free of injury at the time of pick up.

12. SELLER does not offer any health or wellness guarantees applicable after the Sale Animal has left SIZE MATTERS MICRORANCH since SELLER cannot control the management of the Sale Animal once in the possession of BUYER.

13. Except as expressly stated herein, SELLER makes no representations or warranties, express or implied, including warranties of fitness, height, show quality, kid production,

udder quality, milk production, scurs, etc. It is recommended BUYER check the Sale Animal for “defects” (teats or testicles, etc.) before the Sale Animal leaves SIZE MATTERS MICRORANCH. No refund will be given after the Sale Animal leaves SIZE MATTERS MICRORANCH if a “defect” later

appears.

14. Once the Sale Animal leaves SIZE MATTER’S MICRORANCH, it will not be allowed to return without current testing required by SELLER to ensure the biosecurity of SELLER’s herd.

15. This Agreement shall be governed by the laws of the State of Colorado excluding provisions thereof relating to conflicts of laws. If any provision this Agreement is held unenforceable all remaining provisions of this Agreement shall remain in full force and effect. This Agreement contains the entire agreement between the parties relating to the purchase and sale of the Sale Animal, and may be modified only by a written amendment signed by both parties.
